- Definition & Scope of the Contract
- By registering to the site Wishyourgift, the user confirms unconditional acceptance of these Terms and all Notes located on particular pages of Wishyourgift web site, which govern registration, access, navigation and general use of Wishyourgift site. Wishyourgift Site and all the materials contained therein do not constitute an offer to the public, but only a mere invitation to offer. This contract ("Contract") is a distance contract in accordance with article 50 ff of Italian Legislative decree no.206, dated 6 September 2005 ("Consumer Code"). The Contract provides for the sale of goods between Wishyourgift® S.r.l., with registered office in Milano, 20124 - Via Cornalia n. 7, enrolled in the Business Register of Milano and with VAT n. 06742990960, REA n. MI 1912189 (below "Wishyourgift") and the consumer (the "Customer"). Each order of products sent to Wishyourgift from a Customer shall be deemed concluded when he accepted the terms of sale and has paid, unless communication from the bank of the payment. These Terms are governed by Italian Legislative decree no.185 dated 22 May, 1999 (below, the "Decree") implementation of Directive 1997/7/CE on consumer protection in respect of distance contracts and by Italian Legislative decree no.70 dated 9 Aprile 2003, implementation of Directive 2000/31/CE on certain legal aspects of information society services, with particular reference to electronic commerce. The Contract will be filed through an electronic system and will be accessible to staff of Wishyourgift who needs to know in connection with the Contract, to any third party that serves Wishyourgift for the execution of the Contract and the legitimate target under the existing legislation. By sending the order module (below "Module") to Wishyourgift, the Customer allows to use his phone number, email address and all other calling services for the execution of the contract. In particular, the customer authorizes the electronic transmission of invoices relating to orders made on Wishyourgift for an indefinite period until cancellation. Wishyourgift assumes no liability for poor service attributable to force majeure such as accidents, thefts, explosions, fires, strikes and/or lock-outs, earthquakes, floods and other similar events that might prevent performance in whole or in part within the contractually stipulated times. General Conditions as shown in this Site, will be valid and effective until any change or supplement will occur. Any changes and/or additions to the General Conditions will be effective from the date which will be made public and will apply to sales made after that date. - Shipping & Delivery
- All shipping costs (customs duties also), which vary according to country of destination, the number of products purchased, type of carrier selected and the payment method, shall be borne by the Customer. Wishyourgift may not charge the Customer the cost of delivery, in whole or in part.
Deliveries can be made through different carriers; the Customer will be able to choose between several shipping services during the checkout process.
At the time of shipment an e-mail for occurred delivery will be sent to the customer. Wishyourgift is not responsible for any damage due to a delivery delay that is not directly caused by us.

- Wishyourgift uses an e-commerce software that includes the best information encryption techniques according to the SSL (Secure Socket Layer) protocol; hence all personal information and credit card data are sent by the Internet without being accessible to indiscreet eyes. When data are sent and received in a connection to an SSL secure server, masks are displayed that indicate that secure areas have been reached (Hard Copy Form) where the page’s address is characterised by the prefix https. - Warranties
- Wishyourgift guarantees compliance with quality standards relating to its products. The actual products images and colors you see will depend on your computer system, and Wishyourgift cannot guarantee that your computer will accurately display such images and colors. Products purchased through Wishyourgift web site are protected by the manufacturer’s guarantee, as applicable according to the Italian Legislative Decree n° 206 dated 6 September 2005. This guarantee will apply exclusively to malfunctions occurring despite the normal use of the product, i.e., in accordance with its intended use and the provisions of any technical documentation, in compliance with the various operational standards indicated therein. The aforesaid guarantee will not apply in the event of negligence or carelessness in the product’s use or maintenance, or if the item purchased is connected to electrical or other outlets not up to standard.
On certain selected items there are some special warranty conditions:- - iRobot Roomba and Scooba: the fact of opening or modifying the unit of the robot will cancel the warranty.
- - Educational Kits and Electronic Kits: may not be exchanged or refunded once they are assembled in part or in entirety. Only defective components will be replaced if the need arises. Along these lines, please carefully read the construction instructions for the kit and ensure that they are understood before commencing construction. Our manufacturers provide the necessary instructions for proper construction of their kits but can not be held responsible for mistakes made by the builder.
In case of any malfunctions of electronic boards and/or components, as they may result from improper use, for any replacements or repairs, the customer must contact the manufacturer directly. - Right of Withdrawal
- In case of exercise of the right of withdrawal, the products must be returned within the time limits specified to Wishyourgift, in perfect condition for resale and in its original packaging, by the Customer and at its expense (the restitution of the product will not be accepted if it has been put into operation). The products must be returned no later than 10 days after receipt of the products. Once received the goods and verified their integrity, Wishyourgift will refund the price of returned products (excluding charges such as shipping costs, which remain at expense of the Customer).

- Products Availability
- Wishyourgift, notifying the customer, accepts orders beyond the limits of the quantities of products required in the existing stock. Before proceeding in the case of orders with products backordered, the Customer must contact Wishyourgift for information about the delivery time required for these products. Otherwise, once the order is sent, Wishyourgift can not guarantee any delivery period, having to abide by the terms of delivery of the producer.
- Orders & Conclusion of Contract
- To complete a purchase you must register to the site Wishyourgift.
The data provided, that are subjected to the Privacy Policy (D. Lgs. 196/2003), will be stored so that after your first purchase, you will oly need Username and Password (chosen by the Customer) to complete a purchase. Each order of products sent to Wishyourgift from a Customer shall be deemed concluded when he accepted the terms of sale and has paid, unless communication from the bank of the payment. Once the confirmation of your order is received, Wishyourgift will process it and proceed with the shipment of goods within a maximum of three working days. - The purchased products must be paid for by the Customer when the order is confirmed, using one of the payment methods available on Wishyourgift Web Site (credit card, PayPal, cash on delivery or bank transfer), during the checkout process. The Contract will be considered concluded at the time the e-mail confirmation sent by Wishyourgift has reached the e-mail server used by the Customer. Wishyourgift reserves the right to refuse or cancel any purchase order in cases where an account has an outstanding balance or if the module is not duly filled. The sale prices indicated within the site are VAT included if due, calculated by the user during the ordering process. Shipment expenses are excluded. The prices of the products offered are subject to change. Only the price calculated at the time of the order will apply to the Customer’s order, with no consideration of price increases or reductions that may occur. - Law & Jurisdiction
- These conditions comply with Italian law. The tribunal of Milan, Italy, will have jurisdiction and exclusive competence for any controversy and in any case in relation to the above mentioned conditions. However, when necessary, Wishyourgift reserves the right to legal recourse in countries or cities other than Italy and Milan, in order to protect its interests and rights.
